In October 2001, the U.S. Court of Appeals for the Fifth Circuit, in United States vs. Timothy Joe Emerson, held that the Second Amendment gives the individual the right to bear arms. Many young people do not know that they are, in fact, members of the militia under Title 10, Chapter 13, Section 311 of the U.S. Code annotated. There, militia is defined as consisting of all able-bodied males 17 years of age and under 45 years of age who are or wish to become citizens. It also states that there are two classes of militia, one being, "The unorganized militia which consists of the members of the militia who are not members of the National Guard or the Naval Militia."
